Shmoo Tour 2021 – T&C’s

  1. Promotion open to residents in the UK, ROI, Isle of Man and Channel Islands excluding employees and their immediate families of Aimia Foods Limited, their agents and anyone else professionally associated with this promotion.
  2. Consent is required for participants aged 16 years or under to enter.
  3. There are 5 prizes available to be won during the promotion starting the week commencing 1st July 2021 until the 1st  September 2021 – Plus a Grand prize will be drawn at the end of the competition from all entries between 1st July and the 1st September 2021.
  4. The prizes are as follows: 5x £25 voucher of winner’s choice, 1x £50 voucher of winner’s choice.
  5. There are no cash or other alternative prizes available, except that in the event of circumstances outside of the Promoter’s reasonable control, the Promoter reserves the right to substitute similar alternatives of equal or greater value. Prizes are non-transferable.
  6. Entry to the promotion is free and no purchase is necessary.  To enter the Promotion, participants have to follow the instructions specified on the Facebook post on the Promoter’s Facebook page @Shmoothickshakes (the “Page”) or on the Instagram post on the Promoter’s Instagram page @Shmoothickshakes (the “Page”).  Where the Promoter’s notifies a participant that they have won a prize, within 14 days of the Promoter’s notification the winning participant(s) must send the Promoter a private Facebook message via the Page with the winning participant’s details to claim their prize, including the participants full name, email address and postage address.  Where a winning participant’ fails to provide such details to the Promoter within 28 days of the Promoters notifying the participant that they have won a prize, the Promoter reserves the right to withdraw the prize and to award the prize to a substitute winner.
  7. By entering the Promotion, participant’s agree that any personal information provided by them with their entry may be held and used only by the Promoters or its agents and suppliers to administer the Promotion in accordance with the Promoter’s privacy policy, which is available at https://www.aimiafoods.com/privacy-policy/
  8. If you are under 16, you will need your parent or guardian’s permission to enter the promotion. If they consent to your entry, please also enter their full name, a valid email address, their full postal address and a valid telephone number on our social media site where indicated and we will contact them to check that they consent to your participation in the promotion.
  9. No purchase necessary, just complete form online.
  10. Participants may withdraw consent to such use of personal information as referred to in clause 6 above, by writing to the Promoter.
  11. Limit of one entry per week. The Promoter will not accept entries that are: (a) automatically generated by computer; (b) completed by third parties or in bulk; (c) illegible, have been altered, reconstructed, forged or tampered with; or (d) incomplete.
  12. Each week, two winners will be drawn at random from the pool of all valid entrants in that week using independently approved randomising selection software. The first entry drawn will win the 1st prize and the 2nd entry drawn will win the 2nd prize as detailed in the table above.  The Grand prize will be drawn after the 1st September closing date from all the entries during the competition period.
  13. If a person under 16 has requested to enter the promotion, their parent or guardian will be notified by email and will be prompted to enter their postal address details in order to complete promotion entry process. These details will only be used for prize delivery or for publicity (see clause 13) in the event of winning.
  14. In entering the promotion, participants confirm that they are eligible to do so and eligible to claim the prize. The Promoter reserves the right to verify the eligibility of participants and disqualify any participant who is ineligible or whose conduct is contrary to these terms and conditions. Disqualification may result in forfeiture of prizes.
  15. The closing date for the final weekly draw is midnight on 01/09/21.
  16. All winners will be notified by email within 7 days of the close of the draw.
  17. Whilst all reasonable efforts will be made to contact winners by email, if this cannot be achieved within 28 days of first attempting to make contact, the Promoter reserves the right to withdraw prize entitlement and award the prize to a substitute winner drawn at the same time as the original winner.
  18. Please allow 28 days for the delivery of prizes from your notification of winning.
  19. Prize winners may be asked to participate in publicity, however, this is not a requirement of entering the draw and all under 16’s must have their parent’s or guardian’s consent.

  21. The Promoter’s decision regarding all aspects of the promotion will be final and no correspondence will be entered into.
  22. By entering this promotion all participants will be deemed to have accepted and be bound by the terms & conditions. All entry instructions form part of the terms & conditions.
  23. To the fullest extent allowed by law the Promoter will not accept responsibility for loss or injury as the result of promotional participation or acceptance of a prize.
  24. Nothing in these terms shall limit or exclude the liability of the Promoter, its agents and distributors for death or personal injury resulting from negligence, or for fraud or fraudulent misrepresentation (i.e. a deliberate untruthful statement which caused a participant to enter into the promotion).
  25. The Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook, Instagram or Twitter. The participants understand that they are providing information to the Promoter and not to Facebook, Instagram or Twitter. In accepting these terms and conditions, participants release Facebook, Instagram and Twitter from liability to the fullest extent possible in law.
  26. These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
